I'm more on the side of the law in Mass I think. Just because he didn't testify at trial doesn't mean he couldn't/wouldn't have testified at his appeal. Joe makes a good point that the suicide angle makes it tough, but I still think the law is fine. Like others have said, if this ends in his family getting a payday, with the monster being 6 feet under now, I think that is a pretty decent ending for everyone. It sucks for Lloyd's family that the conviction is gone, but I think they know that the guy who did it got his justice.

No convicted murderers played for New England.

I think continuing legal actions after a person's death can be important -liability like poisoned water/products, actual claims of innocence, estate/will issues- but in this case it seems like it was just filed so he could do this legal maneuver.

On the other hand, if an appeal exists so the innocent aren't locked up -even if they're mostly just formalities in most instances- and Hernandez did it just to send money to his family...isn't that subversive? Doesn't that make a mockery of the system? My questions both operate on the same presupposition of 'he's super guilty, his estate is broke, so he's doing (at least as one motivation) as a last gasp to provide for his family...

I don't know what I think the law should state as I don't know the precedent. I don't know what I think the law should be, morally speaking, too.

    I just don't know.
I'm torn on it too. Mainly playing devil's advocate here. I do know that if a loved one of mine was convicted of something I don't believe they did, I'd fight even after their death to clear their name.

This case is interesting, and we haven't heard the last of it because of the implications of his NFL pension, salary, etc. There should be an exception in the case when someone kills themself, because they voluntarily took themself out of the equation. I have no strong feelings one way or another.

I don't know if there should be an exemption - what if a person kills themselves because prison life is too hard? I've no opinion on the matter. I need to read more.

If Hernandez's wife receives the money over this, I doubt that it will last long. I'm sure plenty of lawyers are chomping at the bit to get a job as the Lloyd family's civil lawyer. Hernandez's estate will be Lloyd's estate soon.

Just like OJ, Hernandez will lose the money in a civil case. Kinger, now's your chance! This is the case that could set you up!

Even Lloyd's family getting a payday would be a better ending than the Pats/NFL keeping the money.

He's dead, and the court case should be to. I really hope the DA doesn't waste tax payer dollars trying to convict a dead man.

I was thinking the same thing. What a waste of time and money....

I had a reply typed out then looked up... I think we should tread carefully as this thread is not in P&R.
