Default Man Turns Tables on Credit Card Companies

    This is hilarious:

Guy does to bank what banks usually do to other people

The idea of beating the banks at their own game may seem like a rich joke, but Dmitry Agarkov, a 42-year-old Russian man, may have managed it. Unhappy with the terms of an unsolicited credit card offer he received from online bank Tinkoff Credit Systems, Agarkov scanned the document, wrote in his own terms and sent it through. The bank approved the contract without reading the amended fine print, unwittingly agreeing to a 0 percent interest rate, unlimited credit and no fees, as well as a stipulation that the bank pay steep fines for changing or canceling the contract.

Agarkov used the card for two years, but the bank ultimately canceled it and sued Agarkov for $1,363. The bank said he owed them charges, interest and late-payment fees. A court ruled that, because of the no-fee, no-interest stipulation Agarkov had written in, he owed only his unpaid $575 balance. Now Agarkov is suing the bank for $727,000 for not honoring the contract's terms, and the bank is hollering fraud. "They signed the documents without looking. They said what usually their borrowers say in court: 'We have not read it,'” Agarkov's lawyer said. The shoe's on the other foot now, eh?

Sounds like somebody's fantasy. The writing is so tiny on most of those credit agreements, I don't see how anyone can amend them without scribbling all over them.

"Awesome?" Supporting a man "gaming the system" against, decent, job-creating credit card companies?

    Anti-capitalists, all of you...

Don't try to make this political. I said nothing political at all and stop reading stuff I didn't type in my posts.

Oh, and don't call me names either (except Day1BroncoFan).

Doesn't a legal binding contract have to have consideration for both parties? What consideration did the bank get?

He altered the contract, signed it, sent it back, and the bank approved it. To me, it sounds like both parties agreed to the revised contract.

Not saying they didn't accept it, even if with some deception. My question was about what constitutes a legally binding contract, at least here in the U.S.

In the US, this would be laughed out of court unless it was decided by a jury. Most large businesses have the right to amend the contract as they see fit with the only caveat being that you must receive advance written notice and time to cancel the agreement before the change goes into effect.

Didn't you notice all the banks that got bailout money raising their credit card interest rates right after the recession hit? My Citi card went from 10.9% to 14.9% and I didn't do one damned thing to make it change. The banks decided they needed to pay back that bailout money ASAP so they went about screwing their customers. I transferred my full balance to another bank that gave me 8.9% and have not given Citi a dime ever since - and that bank has never raised their rate on me.

In Russia, laws are probably different (explaining capitalism to Russians after years of communist brainwashing might be a task in itself) but American businesses have an army of lawyers on retainers whose sole job is to make sure nobody can dick with their clients. In an American court, this would not have stood a chance.
