You need to file a police report. Give the police in your jurisdiction all of the info you can. Send the paperwork into the credit card company. Then be diligent in getting it removed. Keep an eye on it because they could try to quick it back on there.

I've experienced this. Many banks protect/reimburse customers when fraudelent activity occurs or is suspected. I'd take this up with them and then report this business to your state

This above. Also, if its fraud it is a criminal offense and not a civil offense. Criminal penalties would apply to the perp, but there is almost no chance of any sort of being awarded "cash in a lawsuit" beyond recovering the amount illegitimately charged, plus court costs. It shouldn't come down to that though.

they are trying to intimidate you with the court costs, I don't see it going go that. You should be able to get your money back easy enough

What do you think this company owes you for them assuming that you owe them? How much time are you going to lose just dealing with this through your CC company; how much time will you lose going to court over this?

Honestly, if you want to file suit over this, then this is not the place to be talking about it. Find yourself a lawyer and see if you have a case.

You just need to contact your credit card company and demand reimbursement. They will send you a form that you complete.

I went through this process once and maybe different banks handle it differently.

But once the form is completed the money will be placed back in your account and then the other party can dispute it by completing a form of their own.

Once the bank gets both forms they will decide who is right.

In my case, I won and got the money back and never heard any more from it.

Its going to cost more to fight it than anything. You will be lucky to get your money back without issue. IMO.

well if your credit card isn't associated with the account, you probably do have a case. If I were a lawyer, I'd defend you for a reasonable fee
