The National Football League Players Association announced on Tuesday that Marty Magid, Elvis Dumervil's former agent, has been suspended for six months and fined $25,000 for showing negligence in contract negotiations with the Denver Broncos this past offseason.

In March, Denver's front office got in a contract dispute with Dumervil's agent over the defensive end's 2013 salary. The Broncos wanted Dumervil to take a pay cut, but Magid didn't want that for his client (or himself).

Allegedly, the two sides agreed on a renegotiated contract which Magid was to fax to the Broncos by a certain time. If the fax did not arrive him time, Denver said they would cut Dumervil.

Things worked out OK in the end for Dumervil, who ended up signing a five-year, $26 million contract with the Ravens. But the NFLPA also said it is still considering action against the Broncos for conduct that may have violated Dumervil’s rights under the CBA.

Something do with the collective bargaining agreement but they did say they are still investigating. But i figured the agent was a little weasel. No offense to any weasels on this board however.


If the Broncos violated the CBA, they may also receive a fine from the league's player union.


It is worth noting that Dumervil, who fired Magid following FaxGate, did not create a contract dispute—the Broncos asked him to renegotiate a contract which they had agreed to. The whole scenario could have been handled better by all three parties, but some may have been more innocent than others.


The action from NFLPA may help to clear up who was in the wrong. As of now, all fingers are pointed at Magid.

Didn't Dumervil and the agent claim they had agreed in principal, but when the Broncos faxed over the final copy there were changes? It could be that.

And the NFLPA left the door ajar for any future action against the Broncos, perhaps a grievance proceeding or other legal action, by adding the punishment handed down on Magid from the union's Committee on Agent Regulation and Discipline "does not foreclose action the NFLPA may take against the NFL club for its conduct, which may have violated the Collective Bargaining Agreement and Dumervil's rights under the CBA.''

Internally, the Broncos have kept a pile of documents, including time-stamped emails and phone records that reconstruct the chain of events that led to Dumervil's release. Privately team officials said Tuesday they didn't expect any additional action toward the organization.

Dumervil originally had a $13 million salary guarantee in place that would have gone into effect at 2 p.m. Mountain time on March 15. After days of back-and-forth negotiations before the deadline on a re-negotiated deal with the team's goal to lower Dumervil's salary cap figure significantly and Dumervil wanting to instead move money around, the Broncos imposed a 1 p.m. deadline on March 15 for Dumervil to take the Broncos' last proposal.

Broncos executive vice president of football operations John Elway has said on several occasions since the 1 p.m. deadline to Dumervil and Magid was in place specifically to give the two sides time to handle any paperwork issues before the league deadline.
