The greatest concern is his scheduled one-day trial Thursday in Atlanta on a misdemeanor battery charge. The incident occurred March 4, 2008, and alleges Marshall struck his former girlfriend.

That incident caused Marshall to serve a one-game suspension last season for violating the NFL's personal conduct policy, but league spokesman Greg Aiello has confirmed the wide receiver was told that a negative result from that charge could potentially lead to further discipline.

Thus, Marshall's immediate future could be left to the six-person jury that will be selected for his trial. Although the trial would not prevent Marshall from playing in the Broncos' first preseason game the next day in San Francisco, his leg injury will.

Marshall still hasn't returned to the practice field since limping off Aug. 2 with what appeared to be a leg injury related to his surgically repaired hip.

Marshall underwent hip surgery March 31, and full recovery is expected to take at least six months. The Broncos' leading receiver with a combined 206 catches the past two years, Marshall dominated the first camp session July 31 but went down two days later.

"Mentally, he's in all the meetings," Broncos coach Josh McDaniels said. "He sees all the film sessions, he sees all the corrections, so I'm not concerned with that. We still have over a month left for that to come into the fold, so he's got plenty of time."
